Elon Musk’s X Corp and SpaceXAI Drop Apple From Federal Antitrust Lawsuit Over OpenAI Exclusivity

Elon Musk’s technology enterprises, X Corp and SpaceXAI, have officially withdrawn their high-profile antitrust lawsuit against Apple, bringing an abrupt halt to legal claims that the consumer electronics giant had colluded with OpenAI to shut rival artificial intelligence developers out of the rapidly expanding market.

In a court filing submitted on Monday, the plaintiffs formally petitioned to dismiss all causes of action brought specifically against the iPhone manufacturer. The document did not provide any substantive rationale for the sudden retreat from the case, nor did it disclose whether Apple and Musk’s entities had negotiated any form of out-of-court settlement agreement to resolve the dispute.

Despite Apple’s removal from the litigation, the broader legal action has not been entirely extinguished. Both X Corp and SpaceXAI confirmed through their filing that they intend to maintain and continue pursuing their legal claims against OpenAI, which remains named as an active defendant in the ongoing proceedings.

The legal dispute originally began in August 2025, when Musk’s companies initiated their antitrust challenge in the United States District Court for the Northern District of Texas, located in Fort Worth. The litigation attacked the deep commercial and technological ties established between Apple and OpenAI, characterizing their partnership as an anticompetitive arrangement designed to control the distribution of generative artificial intelligence software.

Central to the complaint was the accusation that Apple and OpenAI had formed an unlawful pact that designated ChatGPT as the exclusive generative AI chatbot natively embedded within Apple’s core iPhone operating system. The plaintiffs maintained that this exclusive arrangement effectively foreclosed fair competition from rival AI models seeking entry into mainstream consumer hardware.

SpaceXAI, which produces the competing AI chatbot known as Grok, teamed with social media platform X Corp to argue that Apple’s exclusive integration afforded ChatGPT an unfair structural advantage. By integrating OpenAI’s system directly into its hardware ecosystem, Apple allegedly granted the startup immediate access to a vast, captive global audience comprising billions of potential user queries.

The lawsuit detailed multiple native iPhone capabilities that were systematically tied to ChatGPT, highlighting interactions funneled through Apple's virtual assistant Siri, the integrated system-level Writing Tools, and various camera-based features. The plaintiffs argued that feeding these prompt streams exclusively to OpenAI enabled the firm to rapidly train, refine, and scale its systems while starving other companies of critical interaction data.

As a result of this preferential integration, Musk’s companies alleged that rival artificial intelligence developers were effectively deprived of vital direct access to everyday consumer interactions. The arrangement allegedly created substantial barriers to entry, preventing competing models like Grok from building the requisite operational scale and audience reach necessary to challenge the market leader.

In addition to the native operating system integration, the legal filing targeted Apple’s administration of its proprietary App Store. The plaintiffs asserted that Apple systematically disadvantaged external AI chatbot developers through discriminatory practices, which included intentionally dragging out application review cycles and improperly manipulating software marketplace discovery rankings to suppress competing services.

From a statutory perspective, the legal complaint contended that Apple and OpenAI had combined Apple’s dominant foothold in the global smartphone sector with OpenAI’s leading position in generative intelligence to mutually solidify their market control. These collaborative actions, the plaintiffs claimed, constituted direct violations of the federal Sherman Antitrust Act as well as the antitrust statutes of the state of Texas.

The case had already cleared notable legal hurdles prior to the decision to drop Apple from the docket. Both Apple and OpenAI had submitted separate formal motions seeking an outright dismissal of the complaint last year; however, U.S. District Judge Mark Pittman formally denied both dismissal bids in November, thereby clearing the way for the lawsuit to advance toward trial.

OpenAI, for its part, has consistently rejected the substance of the claims, arguing in court filings that Musk was conducting an ongoing campaign of aggressive legal warfare aimed at impeding the artificial intelligence company's growth rather than addressing genuine anticompetitive conduct.

The Texas antitrust case represents just one front in a broader series of legal confrontations instigated by Musk against OpenAI. In a separate legal dispute, Musk claimed that OpenAI had breached its founding mission by abandoning its original non-profit objective to build artificial intelligence solely for the general benefit of humanity in pursuit of commercial profitability, a suit that OpenAI successfully defeated in May.

These extensive legal maneuvers have unfolded against the backdrop of ChatGPT’s extraordinary commercial emergence. Following its public debut in late 2022, OpenAI’s flagship tool rapidly became the fastest-growing consumer software application in recorded history, establishing a commanding early lead in generative technology that continues to generate fierce competitive challenges and regulatory scrutiny.
