Brazil’s Supreme Court Paralyzed by Internal Rifts and Expanding Banking Scandal

Brazil’s Supreme Court has suspended its regular deliberations for a second consecutive day, as a fierce internal dispute fueled by allegations of political bias, corruption, and improper interference threatens to paralyze the nation’s highest judicial body.

Cancellations of official hearings are exceptionally rare for the top court, underscoring the severity of the institutional deadlock. Chief Justice Luiz Edson Fachin took the decisive step on Thursday to halt the day’s scheduled proceedings, formally ordering that the bench reconvene early next week on Tuesday instead.

The unprecedented operational shutdown comes as deep divisions among the justices spilled into public view, triggered by actions taken at the beginning of the month. On September 1, Justice Andre Mendonca made public a series of unsealed federal police files that implicated a fellow member of the bench in communications with a disgraced financial figure.

The unsealed case files contained roughly 30 text messages that were allegedly sent by Daniel Vorcaro, the former head of the collapsed Banco Master financial institution. The records indicated that the messages were directed to a phone number connected to Justice Alexandre de Moraes, appearing to show the banker seeking advice from the high-profile magistrate.

Justice de Moraes has become one of the most prominent and polarizing figures in Brazilian public life in recent years. He notably presided over the landmark prosecution of former far-right President Jair Bolsonaro, who was tried and convicted of plotting a coup following his 2022 election loss and is currently serving a 27-year prison sentence.

De Moraes also drew intense scrutiny and condemnation from right-wing circles after enforcing strict judicial mandates on digital communications, including ordering suspensions of major online platforms such as X and Rumble for defying legal directives.

Following the release of the unsealed messages, de Moraes launched a sharp counterattack against Mendonca, who was appointed to the high court by the former Bolsonaro administration. De Moraes accused his colleague of weaponizing his judicial powers for partisan ends and formally petitioned for an inquiry to determine if Mendonca had privately questioned Vorcaro without prosecutors or police investigators present.

The escalating confrontation is set to reach a critical juncture during Tuesday’s planned session. The full 11-member bench is scheduled to gather, with 10 of the sitting justices slated to deliberate and vote on whether de Moraes himself should face a formal internal investigation regarding his purported communications with Vorcaro.

The judicial infighting represents the latest institutional ripple effect stemming from the sprawling Banco Master corruption scandal. Vorcaro was taken into custody in November 2025 on charges of orchestrating a massive multi-billion-dollar fraud that misled investors, marking one of the most severe financial debacles in Brazilian history.

The subsequent downfall of Banco Master’s private banking division left a trail of financial devastation, including more than $7bn in outstanding liabilities. As federal investigators continue to unravel the institution's dealings, the widening inquiry has ensnared politicians and officials from across the entire political spectrum.

The judiciary’s crisis arrives at an especially delicate moment for South America’s largest democracy, which is gearing up for nationwide general elections in October. The volatile situation threatens to cast a heavy shadow over the impending presidential contest, where incumbent left-wing President Luiz Inacio Lula da Silva is slated to face Senator Flavio Bolsonaro, the eldest son of the imprisoned former president.

Both presidential contenders have publicly weighed in on the turmoil, demanding thorough investigations into the conduct of the Supreme Court justices as the integrity of the judicial branch is called into question.

The Bolsonaro family is already navigating its own direct entanglements with the Banco Master controversy. An investigative report published in May by Intercept Brasil disclosed that Senator Flavio Bolsonaro had personally approached Vorcaro to secure funding for a biographical film about his father, titled Dark Horse.

While Senator Bolsonaro has maintained his innocence, arguing that he merely sought legitimate private sponsorship for the media project, law enforcement scrutiny surrounding the production has escalated dramatically.

On Thursday, federal police conducted dozens of targeted raids linked to the Banco Master case. Among those subjected to the search operations were Karina Gama, who heads the production company behind the film, and federal Congressman Mario Frias, who acted as the project's executive producer.

Senator Bolsonaro has firmly rejected the legitimacy of the recent police raids and high court scrutiny, denouncing the ongoing investigations as a deliberate attempt at political interference designed to sway the electorate ahead of October’s pivotal vote.
